Terms and Conditions of Use

Preliminary considerations
This document (the "Terms") constitutes a binding legal agreement between TUNEGOCIO IA S.A.S, a commercial company duly organized under the laws of the Republic of Colombia, identified with Tax ID ("NIT") 902.061.281, with principal domicile in Barranquilla, Republic of Colombia (hereinafter, the "Operator"), and any individual who accesses, registers, purchases Trips, or otherwise participates in the game known as THE10MDG (hereinafter, the "Player").
Access to and use of the Game implies full, express, and unconditional acceptance of these Terms in the version in force at the time of access. If the Player does not agree with everything set forth herein, the Player must refrain from registering, purchasing Trips, or participating.
1 — Definitions
For purposes of these Terms, the following terms shall have the meanings indicated below, whether used in the singular or plural:
- Game:
- The two-dimensional platform video game known as THE10MDG, accessible at the10milliondollargame.com and its subdomains, including its official level, simulation engine, verification server, and interfaces.
- Account:
- The Player's personal, non-transferable registration, associated with a verified email address.
- Trip:
- The unit of participation and the product the Player purchases. A Trip enables one complete timed run of the official level, from its start until the finish line is crossed. A Trip is not consumed upon death: the Player respawns at the last Checkpoint reached as many times as necessary, with the clock running. A Trip ends only by: (a) crossing the finish line; (b) voluntary abandonment; or (c) closure of the Round.
- Credit:
- Each purchased unit that enables a Trip. The terms 'Credit' and 'Trip' are used interchangeably with respect to the purchased unit.
- Checkpoint:
- A level position where the Trip's progress is recorded by the server and from which the Player respawns after dying.
- Official Time:
- The verified duration of a completed Trip, measured by the Operator's server in active simulation frames (60 frames = 1 second), as the sum of all re-simulated frames of every playthrough making up the Trip, plus any penalties applicable under Section 11. Official Time is determined exclusively by the server and never by the Player's device.
- Record:
- The best Official Time obtained by a Player in a given Round.
- Time Table or Leaderboard:
- The public ranking of the best Records of the current Round.
- Round:
- A competition period with a start date and a fixed closing date, with its own prize schedule and configuration, published before it begins.
- Site:
- the10milliondollargame.com, its subdomains, and associated interfaces.
2 — Purpose and acceptance
- These Terms govern access, registration, participation, the purchase of Trips, the prize system, the winner verification process, and other conditions of use of the Game.
- Acceptance of these Terms is perfected by any of the following acts: (a) creating an Account; (b) purchasing Trips; (c) starting any Playthrough; or (d) continued use of the Site.
- The Player represents that acceptance is given freely, knowingly, and voluntarily, and that the Player has the legal capacity to be bound.
- These Terms are supplemented by the Privacy Policy and by the specific rules of each Round published on the Site, which form an integral part of this agreement.
3 — Legal nature of the game: skill and dexterity, total absence of chance
- THE10MDG is a game of pure skill and dexterity. The outcome of each Playthrough depends solely and exclusively on the Player's precision, coordination, practice, memory, and execution.
- The Game is fully deterministic: the official level, the position and behavior of each obstacle, the simulation physics, and all game conditions are identical for every Player, in every Playthrough, at every moment of a given Round. There is no random generation of events, no elements of luck, no drawings, and no role played by chance in any component of the Game. Two Players who execute exactly the same inputs will obtain exactly the same result.
- Accordingly, the Game does not constitute a game of chance ("juego de suerte y azar") within the meaning of Article 5 of Ley 643 de 2001 (the Colombian law governing games of chance), which defines such games as those whose result "cannot be predicted with certainty because it is determined by luck, chance, or randomness," and which expressly excludes from its scope games of strength, skill, or dexterity, which are governed by their own rules. The Game is not, and may not be construed as, a lottery, raffle, bet, drawing, promotional game, or any other modality subject to the state monopoly over games of chance.
- The prizes offered are fixed, predetermined, and announced before the start of each Round, and are fully funded by the Operator out of its own resources. The value of the prizes is not made up of, does not depend on, and does not vary based on payments made by Players, the number of participants, or the Round's revenue.
- Payments made by the Player correspond exclusively to the purchase of Trips as a digital entertainment product, and under no circumstances constitute a wager on an uncertain outcome.
4 — Eligibility
- Only individuals who are eighteen (18) years of age or older at the time of registration, with full legal capacity to contract, may participate.
- By registering, the Player represents, under penalty of perjury, that: (a) the Player is of legal age; (b) the information provided is truthful, complete, and current; (c) the Player is participating on their own behalf and not on behalf of third parties; and (d) the Player's participation does not violate the laws of their place of residence.
- Participation is prohibited for: (a) minors; (b) legal entities; (c) employees or contractors of the Operator, with respect to the ability to claim prizes.
- The Operator may restrict, limit, or block access from jurisdictions where participation would be contrary to local law, without any liability arising from doing so. It is the Player's sole responsibility to verify the legality of their participation under the laws applicable to them.
5 — The player's account
- One (1) Account per person. The creation, possession, or use of multiple Accounts by the same person, whether directly or through a third party, constitutes a serious violation of these Terms and is grounds for disqualification, annulment of victories, forfeiture of Trips, and closure of all Accounts involved.
- The Account is personal and non-transferable. Its sale, assignment, loan, lease, or any other form of transfer or shared use is prohibited.
- The Player is solely responsible for safeguarding and keeping confidential their login credentials. All activity carried out from the Player's Account is presumed to have been carried out by the Player.
- The Player must immediately notify the Operator of any unauthorized use of their Account or compromise of their credentials.
- The Operator may preventively suspend an Account where there is reasonable evidence of a violation of these Terms, while the relevant verification takes place.
6 — Trips
- The Trip is the product purchased by the Player. It enables one complete timed run of the official level.
- Dying does not consume the Trip. The Player respawns at the last Checkpoint reached, at no additional cost and with no limit on retries, with the Trip's clock running. Deaths cost time, not money.
- A Trip ends only by:
- Crossing the finish line: the Trip is recorded as completed and its Official Time is added to the Time Table if it improves the Player's Record;
- Voluntary abandonment: the Player may abandon a Trip in progress using the corresponding function, subject to double confirmation. Abandonment consumes the Credit, records no time, and is irreversible. An abandoned Trip produces no Record and does not appear in any ranking;
- Closure of the Round: as provided in Section 10.
- One (1) open Trip per Player at a time. To start a new Trip, the previous one must have ended for any of the reasons in clause 6.3.
- Credits: (a) do not expire; (b) are not transferable between Accounts; (c) are not exchangeable or convertible into money, except as provided in Section 8; (d) have no value outside the Game; (e) do not constitute a deposit, financial balance, or means of payment.
- Complimentary and bonus Credits are governed by the same rules and have no monetary value.
7 — Prices and payments
- Prices for the current Round: three (3) Trips for ten thousand Colombian pesos ($10,000 COP) and one (1) Trip for five thousand Colombian pesos ($5,000 COP), taxes included where applicable.
- Prices may be changed between Rounds or by announcement on the Site. Changes do not affect purchases already made.
- Payments are processed through the Wompi (Bancolombia) payment gateway in Colombian pesos. The Operator does not directly collect, store, or have access to the Player's card data or payment instruments, which are handled exclusively by the payment gateway in accordance with its own terms and security certifications.
- Credits are credited only after the payment gateway effectively confirms payment. No message, receipt, or assertion from the Player substitutes for such confirmation.
- If a confirmed payment is not reflected in the Account within a reasonable time, the Operator's reconciliation system will credit it automatically; failing that, the Player may report it to the support email with their payment reference, and the Operator will resolve it based on its own records and those of the payment gateway.
- The cancellation, reversal, or chargeback of a payment after Credits have been granted will entitle the Operator to review the case individually. The Operator will not automatically remove Credits; however, it may suspend the Account, withhold participation in prizes, and adopt appropriate measures while the dispute is resolved, without prejudice to the Player's legal rights and to the Operator's legal remedies in the event of fraud.
8 — Right of withdrawal and refunds
- Pursuant to Article 47 of Ley 1480 de 2011 (the Colombian Consumer Protection Statute), the Player may exercise the right of withdrawal within five (5) business days following the purchase of a Trip package, obtaining a refund of the money paid, provided that none of the Trips in the package have been consumed.
- Consuming at least one (1) Life from the package constitutes the start of performance of the service with the consumer's express consent and, consequently, extinguishes the right of withdrawal with respect to the entire package, under the terms of the applicable regulations.
- Withdrawal is exercised by contacting the support email and stating the purchase reference. The refund will be made through the same payment method within the legal deadlines.
- System failures: if a Trip is lost as a result of a verifiable technical failure attributable to the Operator (according to its technical and forensic records), the Operator will restore the affected Life at no cost, once the failure has been verified. Restoring the Trip constitutes the full remedy for such events, without prejudice to the consumer's non-waivable rights.
- Outside the cases provided for in this Section, purchases of Trips are non-refundable, given their nature as immediately-consumed digital content.
9 — Official Time and its measurement
- The Official Time of a Trip is measured in active simulation frames, not wall-clock time. Only frames actually simulated during play are counted.
- Accordingly, pauses, screen off, app switching, incoming calls, and other interruptions do not increase the Official Time, provided the Game client closes the session correctly. This rule specifically protects Players on mobile devices.
- All simulated frames of every playthrough within the Trip are counted, including those ending in death and those interrupted by disconnection. This rule is essential to competitive integrity: without it, deliberately interrupting a playthrough would allow already-played time to be discarded.
- Irregular-closure penalty. Any playthrough that does not end in an orderly manner — silent disconnection, malformed close, detected illegal input, or client manipulation — will add its simulated frames plus a fixed penalty of ten (10) seconds to the Trip's Official Time. This penalty: (a) is identical for all Players; (b) is shown on screen to the Player when applied; (c) does not apply to deaths, normal restarts, or orderly device interruptions (app switching, screen off, incoming call); (d) does not apply where the interruption is caused by an Operator failure, in which case the affected frames are fully deducted.
- Official Time is determined exclusively by the server through verified re-simulation of the Player's recorded inputs. The clock displayed during play is informational; in the event of discrepancy, the server's Official Time prevails.
- The Operator may change the penalty value in clause 9.4 between Rounds, with prior announcement. It will never be changed during an ongoing Round.
10 — Rounds, Time Table, and prizes
- Each Round has a fixed closing date, published on the Site from its start and visible via a countdown.
- Current Round. Prize schedule: first place: one million Colombian pesos ($1,000,000 COP); second place: three hundred thousand Colombian pesos ($300,000 COP); third place: two hundred thousand Colombian pesos ($200,000 COP).
- Prizes are awarded by ranking of Official Time at the moment the Round closes: the best verified Record takes first place, the next takes second, and so on. Order of arrival grants no prize by itself: a Player who completes their Trip on the last day may take first place if their Record is the best.
- Tie-breaking. If two or more Records are identical to the frame, the higher position is awarded to whoever achieved it first, according to the Operator's server clock, whose record constitutes full proof.
- Ranking cutoff. Only Trips completed before the published closing date and time are considered. Any delay in the technical execution of the closure does not alter the cutoff: Trips completed after the closing date do not enter the ranking, regardless of their Official Time.
- Early closure. The Operator may close a Round before its scheduled date by announcement on the Site. In such case: (a) the ranking is determined by the verified Records at the time of closure; (b) prizes for positions not reached are neither awarded nor accumulated; (c) unused Credits remain fully valid for subsequent Rounds.
- Trips in progress at closure. If the Player has a Trip in progress when the Round closes, the Credit will be automatically returned and the Player will additionally receive two (2) complimentary Credits as the sole compensation for the interruption.
- Per-Round configuration. Level composition, Checkpoint density, and other difficulty parameters may vary between Rounds and are announced at the start of each one. Such parameters are never modified during an ongoing Round: all Players in the same Round compete under identical conditions.
- The Time Table is public and displays only the username and Record of ranked Players. It is updated periodically and its content is informational until the Round closes, at which point it freezes and determines the winners, subject to the verification in Section 11.
- The Operator's long-term goal of distributing ten million dollars (USD $10,000,000) in prizes across all seasons is a business aspiration, not an offer or enforceable obligation with respect to any Round. The only enforceable prizes are those of each Round's current schedule.
11 — Winner verification
- Once the Round closes, Records occupying prize-winning positions enter a "pending verification" status. No prize is paid, recognized, or published automatically, and appearing on the Time Table does not by itself grant a right to the prize.
- The verification process includes, at the Operator's reasonable discretion:
- Technical verification: full re-simulation of the winning Trip and all of its playthroughs, cryptographic validation of the Checkpoint chain, and confirmation of the Official Time;
- Forensic analysis: review of recorded inputs, behavioral metrics, consistency across the Player's Trips, comparison with system reference times, and other technical signals in the Player's history;
- Live verification session: a real-time video call in which the Player must demonstrate their skill level by playing before the Operator, under reasonable conditions it may request, including up to four (4) simultaneous camera angles (screen, hands, face, and environment), without third-party assistance or unauthorized tools. The Player is expected to reproduce performance consistent with the claimed Record;
- Identity verification: valid identity document matching the Account.
- The Player undertakes to cooperate in good faith, attend the video session within the reasonable timeframes proposed, and refrain from obstructing verification. Unjustified refusal, repeated failure to appear, or obstruction entitles the Operator to reject the Record.
- If a Record is rejected for evidence of automation, manipulation, impersonation, multi-accounting, or any breach of these Terms, the position passes to the next Player in the ranking, who will in turn enter the verification process. The infringing Account may be permanently closed.
- The Operator's decisions are based on available technical and forensic evidence, are communicated to the Player, and are final at the Operator level, without prejudice to the Player's legal rights to challenge them.
12 — Prize payment and taxes
- Once verification is approved, the prize will be paid within the following thirty (30) calendar days, by transfer to a bank account or payment instrument in the name of the verified winner. No payments will be made to third parties, in cash, or through channels other than those specified by the Operator.
- Prizes are paid in Colombian pesos (COP), the currency in which they are denominated. For winners outside Colombia, the costs, fees, and exchange-rate differences of the international payment method used will be borne as disclosed to the winner before payment.
- Taxes and withholdings. Prizes may be subject to taxes, withholding at source, and other tax charges required by Colombian law — including, where applicable, the occasional gains ("ganancias ocasionales") regime — or by the law of the winner's country of residence. Any withholding that the law requires the Operator to apply as a withholding agent will be deducted from the prize amount at the time of payment. All other taxes, filings, and tax obligations arising from receipt of the prize are the sole responsibility of the winner.
- The Operator may publish the username of verified winners, together with the position obtained and the corresponding prize, as part of the Game's public transparency record. Publication of additional personal data (real name, image, video) requires the winner's prior, express consent.
13 — Fair play — prohibited conduct
- The Game is designed to be played exclusively by humans, in real time, using direct physical inputs (keyboard or the Game's official touch controls). The following constitute serious violations of these Terms, by way of example and not limitation:
- the use of bots, scripts, macros, autoclickers, automation tools, artificial intelligence, or any form of non-human assistance to perform or assist in performing Playthroughs;
- the manipulation, modification, injection, or alteration of the Game client, its code, its memory, network traffic, or data transmitted to the server;
- the use of input emulators, playback of recorded input sequences (replay/TAS), artificial slowdown of simulation time, or any technique that alters the relationship between human action and input recording;
- exploiting bugs, glitches, or vulnerabilities in the Game or its infrastructure for one's own benefit or that of third parties; detected bugs must be reported to the support email;
- unauthorized access or attempted access to systems, servers, databases, or third-party accounts;
- creating or using multiple Accounts, impersonation, and shared use of Accounts;
- any form of interference with the Game's infrastructure, including denial-of-service attacks, deliberate overload, or unauthorized vulnerability scanning;
- abuse of the referral program through self-referrals, fraudulent accounts, or artificial schemes.
- Consequences. Violation of this Section will entitle the Operator, depending on severity and on a proportionate basis, to: annul Playthroughs and Victories; invalidate progress obtained through the violation; remove the Trips involved in the offending conduct; disqualify the Player from the Round; suspend or permanently close the Account; and refuse the offender's future participation. Trips used in committing the violation will not be refunded.
- The foregoing measures will be adopted based on the technical and forensic evidence from the Operator's systems, will be communicated to the Player, who may submit observations to the support email, without prejudice to the Player's legal rights.
14 — Technical verification system and records
- The Player acknowledges and accepts that, as an essential condition of the Game's competitive integrity, the Operator's server permanently records all inputs of each Playthrough, the session's technical metrics, data arrival times, technical characteristics of the browser and device relevant to detecting automation, and the other technical data described in the Privacy Policy.
- Such records: (a) constitute the technical basis for verifying Victories and detecting violations; (b) are retained as evidence of the decisions made; and (c) prevail, for all purposes of these Terms, over any record, recording, or assertion originating from a source other than the Operator's server.
- The server independently re-simulates and verifies each segment of every Player's progress. Progress that the server cannot fully verify will have no effect.
15 — Referral program
- Each Player has a personal referral link or code.
- Referred Player benefit: anyone who registers using a referral code receives one (1) additional free Trip with their first purchase of the ten thousand peso ($10,000 COP) pack, within their first three (3) purchases.
- Referring Player reward: the referrer earns free Trips, not cash: one (1) Trip for each purchase of the five thousand peso ($5,000 COP) pack and two (2) Trips for each purchase of the ten thousand peso ($10,000 COP) pack made by the referred Player. The benefit applies only to the first three (3) purchases of each referred Player; from the fourth purchase onward, no reward is generated.
- Nature and recording. Rewards consist exclusively of Trips credited to the referrer's Account. They carry no right to money, are not redeemable for cash and are not transferable to another Account.
- Anti-fraud review. The Operator verifies the legitimacy of every purchase that generates referral Trips and may revoke Trips granted for fraudulent or reversed purchases.
- Reversed purchases. If a purchase that generated referral Trips is refunded, cancelled, or charged back, the corresponding unused Trips are voided. A reversed purchase still uses up its slot within the three-purchase cap.
- Prohibited conduct. The following constitute serious breaches: self-referral directly or through an intermediary, creating accounts to generate referral Trips, and any artificial scheme designed to obtain the benefit without a genuine purchase by a real third party. The Operator records technical signals associated with each reward for review, and may revoke Trips resulting from such conduct, in addition to applying the sanctions in Section 13.
- The Operator may modify or discontinue the program going forward by announcement on the Site, without affecting Trips already credited.
16 — Availability, maintenance, and updates
- The Operator will endeavor to keep the Game continuously available; however, it does not guarantee uninterrupted or error-free availability. The Game is provided "as is" and "as available," to the maximum extent permitted by law, without prejudice to the consumer's non-waivable legal warranties.
- Maintenance, update, or technical deployment work may interrupt Playthroughs in progress. In such case, the Trip consumed in the interrupted Playthrough will be automatically refunded to the Player. Such refund constitutes full compensation for the interruption.
- The Operator will not be liable for failures, interruptions, or deficiencies attributable to: (a) the Player's internet connection; (b) the Player's devices, browsers, or operating systems; (c) third-party services (infrastructure providers, payment gateways, email services) outside the Operator's direct control.
17 — Intellectual property
- The Game and all of its components — including, without limitation, its source and object code, simulation engine, level design, mechanics, graphics, interfaces, text, trademarks, trade names, logos, music, and sound effects — are the exclusive property of the Operator or are used under license, and are protected by applicable intellectual and industrial property laws.
- Acceptance of these Terms grants the Player only a limited, personal, revocable, non-exclusive, and non-transferable license to access and play the Game in accordance with these Terms. No additional rights are conferred.
- Reproduction, distribution, unauthorized public communication for commercial purposes, transformation, decompilation, reverse engineering, or extraction of components of the Game is prohibited, except for mandatory legal exceptions. Streaming and publishing audiovisual content of the Player's own gameplay (streaming, videos) is permitted and welcome, provided it does not reveal vulnerabilities or violate these Terms.
18 — Personal data protection
- Processing of the Player's personal data is governed by the Privacy Policy published on the Site, issued in compliance with Ley 1581 de 2012 (Colombia's Data Protection Statute), Decreto 1377 de 2013, and other applicable regulations. The Privacy Policy is an integral part of these Terms.
- For the winner verification process, the Operator will process additional data — including the identity document and the recording of the video verification session — for the sole purpose of validating the legitimacy of the Victory, retaining such data as evidentiary support for the decision made, in accordance with the Privacy Policy.
19 — Limitation of liability
- To the maximum extent permitted by Colombian law, the Operator's total and cumulative liability to a Player, for any cause related to the Game, is limited to the amount actually paid by that Player to the Operator during the six (6) months preceding the event giving rise to the claim.
- The Operator will not be liable for lost profits, loss of opportunity, or indirect or consequential damages, to the extent the law permits such exclusion.
- Nothing in these Terms limits, excludes, or restricts: (a) the consumer's non-waivable rights under Ley 1480 de 2011; (b) liability that the law does not allow to be limited; (c) the Player's right to bring a claim before the Superintendencia de Industria y Comercio (Colombia's consumer protection and competition authority) or the competent courts.
20 — Indemnification
The Player will hold the Operator harmless from third-party claims arising from: (a) the Player's violation of these Terms; (b) illegal or unauthorized use of the Game; (c) infringement of third-party rights in connection with the Player's participation. This obligation does not apply to the extent the harm is attributable to the Operator.
21 — Force majeure
The Operator will not be liable for failures or delays caused by events of force majeure or fortuitous events, including, without limitation: natural disasters, widespread internet or electrical infrastructure failures, acts of government authority, conflicts, large-scale cyberattacks against third-party providers, or any other unforeseeable and unavoidable circumstance beyond its reasonable control. Once such event has passed, the Operator will restore service and adopt equitable measures with respect to affected Playthroughs and Rounds.
22 — Amendments to the terms
- The Operator may amend these Terms at any time. Amendments will be published on the Site indicating their effective date and will apply prospectively.
- Material amendments affecting the essential conditions of an ongoing Round — including its Prize Schedule and difficulty configuration — will not apply to that Round, unless they are more favorable to Players or are required by law or a competent authority.
- Continued use of the Game after amendments are published constitutes acceptance of those amendments.
23 — Assignment
The Player may not assign their contractual position or the rights arising from these Terms. The Operator may assign this agreement to an affiliated company or to an acquirer of its operations, guaranteeing the continuity of Players' rights, with notice on the Site.
24 — General provisions
- Severability. The nullity, invalidity, or unenforceability of any provision of these Terms will not affect the validity of the remaining provisions, which will retain their full binding force.
- Entire agreement. These Terms, together with the Privacy Policy and the specific rules of each Round, constitute the entire agreement between the parties regarding the Game and supersede any prior communication or understanding.
- No waiver. The Operator's tolerance of, or failure to exercise, a right does not constitute a waiver of it and does not prevent its later exercise.
- Survival. Sections that by their nature must survive termination of the relationship (intellectual property, technical records, limitation of liability, indemnification, governing law) will remain in effect.
- Language. These Terms are drafted in Spanish. Translations into other languages are published for the Player's convenience; in the event of any discrepancy, the Spanish version shall prevail.
25 — Notices and contact
- The Operator's communications to the Player will be sent to the email address registered on the Account or published on the Site, and will be deemed received the day after they are sent or published.
- The Player's communications to the Operator must be directed to the support email. Requests, complaints, and claims will be handled within the timeframes provided by law.
26 — Governing law and jurisdiction
- These Terms are governed by and construed in accordance with the laws of the Republic of Colombia.
- Any dispute arising out of these Terms or the Game will be heard by the competent courts of the Republic of Colombia, without prejudice to: (a) the consumer's rights to bring a claim before the Superintendencia de Industria y Comercio; (b) mandatory consumer protection rules of the Player's place of residence that may be applicable.
